Thank you for visiting Job Service North Dakota's online web applications. These web applications are designed to make it easier and more efficient for individuals and employers to conduct business with Job Service North Dakota (JSND).

JSND recognizes that it is critical for individuals and businesses to be confident that their privacy is protected when they visit JSND's online applications. Consistent with the provisions of the Internet Security and Privacy Act, the Freedom of Information Law, and the Personal Privacy Protection Law, this policy describes JSND's privacy practices regarding information collected from users of these applications.

PROTECTING THE CONFIDENTIALITY OF YOUR DATA

Job Service North Dakota recognizes the need to protect personal information collected through these web applications against unauthorized access, use, or disclosure. JSND limits employee access to personal information collected through this website to those employees who need access to all the information to perform their official duties. Employees with access to personal information are made aware of the need to follow appropriate procedures in connection with any disclosure of that information. In addition, employees are subject to statutes that provide that Unemployment Compensation data is confidential, and provide criminal penalties for divulging that information.

For website security purposes and to maintain the availability of the website for all users, JSND employs processes to monitor traffic to identify unauthorized attempts to upload or change information, or otherwise damage this website.

The information provided in this privacy policy should not be construed as giving business, legal, or other advice, or warranting as fail proof, the security of information provided through these web applications.

PRIVACY AND SECURITY

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, JSND has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information collected online. These security procedures have been integrated into the design, implementation, and day-to-day operations of the applications as part of our continuing commitment to the security of electronic content and electronic transmission of information.

Job Service North Dakota has implemented procedures to safeguard the integrity of its information technology assets, including, but not limited to, the use of firewalls and authenticating, monitoring, auditing, and encrypting. The information you provide to us online is protected and encrypted by Secure Socket Layer (SSL) technology, which helps prevent unauthorized use of your information.

OUR DISCLOSURE OF YOUR INFORMATION

Job Service North Dakota does not sell or rent any of your personal information to third parties for marketing purposes. However, in accordance with state and federal laws, JSND will cooperate with law enforcement inquiries and authorities in investigations relating to intellectual property rights, fraud and other rights, criminal investigations or alleged illegal activity. Job Service North Dakota may disclose personal information to federal or state law enforcement authorities to enforce its rights against unauthorized access or attempted unauthorized access to the agency's information technology assets, or against other inappropriate use of these applications.

Job Service North Dakota may disclose personal information to those agencies specifically addressed in the North Dakota Century Code or relevant federal laws.

HOW WE USE YOUR INFORMATION

We use your personal information to facilitate the service(s) you request. We do not collect personal information unless you provide it voluntarily by utilizing the JSND online applications or by sending an email to JSND. Personal information is not gathered when you are just browsing or downloading information from the JSND website. You may choose not to utilize the JSND online applications or communicate with JSND through use of email. Your choice not to participate in these activities may limit your ability to receive specific services or products through these web applications, but does not limit your ability to receive services from JSND through other available options.

If, during your visit to the UI EASY or UI ICE applications, you send an electronic mail message to Job Service North Dakota, your electronic mail address and the contents of your message will be collected. The information collected is not limited to text characters and may include audio, video, and graphic information formats included in the message. Your electronic mail address and the information included in your message will be used to respond to you, to address issues you identify, to improve this website, or to forward your message to another agency for appropriate action. Your electronic mail address is not collected for commercial purposes, and JSND does not sell or otherwise distribute your electronic mail address for commercial purposes.

During your visit to this application, you may initiate an online payment transaction. The information, including your personal contact and financial information, volunteered by you in initiating the transaction, is used by JSND to complete the transaction. If there are difficulties completing the transaction, the contact information may be used to get in touch with you.

HOW LONG DOES JSND RETAIN THIS INFORMATION?

Information collected through the UI EASY or UI ICE applications is retained by JSND in accordance with the records retention and disposition requirements of the North Dakota Records Management Law. Information, including personal information that you submit in an electronic mail message, is retained in accordance with the records retention and disposition schedule established for the records of the program unit to which you submitted the information. Information concerning these records retention and disposition schedules may be obtained by contacting Job Service North Dakota.

CONTROL OF YOUR ACCESS CODE OR PERSONAL IDENTIFICATION NUMBER

You are responsible for all actions taken with your Access Code/Personal Identification Number (PIN), including access to your account. Therefore, we recommend that you do not disclose your Access Code/PIN to third parties. If you choose to share your Access Code/PIN, you are responsible for all actions taken with your account by other individuals whom you allow to access to your account. If you lose control of your password/PIN, you may lose security over your personal information, and may be subject to legally binding actions taken by others on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your Access Code/PIN as detailed in the applications.

Because of the confidential and sensitive nature of information available to users of the web applications, JSND strongly recommends that users develop "strong" Access Codes/PIN. Selecting a secure Access Code/PIN is critical since it reduces the risk of someone gaining unauthorized access to resources by impersonating you.
